What is Minijob — Befreiung von der Rentenversicherungspflicht?

In Germany, people in a mini-job (a geringfügig entlohnte Beschäftigung) are in principle compulsorily insured in the statutory pension scheme. The Minijob-Zentrale's leaflet on the form explains that the employee's own share is 3.6 percent of pay in a commercial mini-job (13.6 percent in a private household), topping up the employer's flat-rate contribution to the full 18.6 percent. Under § 6 Abs. 1b SGB VI you can ask to be exempted, and this form is that request.

You fill in your name and pension insurance number, then sign and date the top half. Your employer notes the day the form arrived and the date the exemption applies from, signs, and keeps the form with the payroll records. The notice on the form says it is not sent to the Minijob-Zentrale. The employer reports the exemption instead.

Who needs to fill out Minijob — Befreiung von der Rentenversicherungspflicht?

  • Mini-jobbers who don't want to pay their own share of statutory pension insurance.
  • People starting a mini-job, since the request is usually handed over with the other new-hire paperwork.
  • Mini-jobbers with several mini-jobs at once. The exemption can only be requested for all of them together, and every employer must be told.
  • Employers of mini-jobbers, who confirm receipt, set the start date and keep the form.

When to use Minijob — Befreiung von der Rentenversicherungspflicht

  • When you start a mini-job, or at any later point while you have one, if you want to stop paying your own pension contribution.
  • Before deciding, read the leaflet on pages 2 and 3. It recommends individual advice from Deutsche Rentenversicherung first, free on 0800 10004800.
  • The exemption normally applies from the start of the calendar month in which your employer receives the request, and at the earliest from the start of the job. That holds if the employer reports it to the Minijob-Zentrale by the next payroll run and within 6 weeks at the latest.

  • Your 12-character pension insurance number (Rentenversicherungsnummer), from your social insurance ID or letters from Deutsche Rentenversicherung.

How to fill out Minijob — Befreiung von der Rentenversicherungspflicht, step by step

1 Arbeitnehmer/-in (the mini-jobber)

Your surname, first names and pension insurance number go in the boxes at the top. The number goes one character per box: two digits, your date of birth as six digits, a letter, then three digits.

2 The declaration

By signing you request exemption from compulsory pension insurance in your mini-job and give up earning compulsory contribution periods. You confirm that you have read the leaflet, that the exemption covers all mini-jobs you hold at the same time and is binding for as long as they last, and that you will tell every other mini-job employer about it.

3 Ort, Datum and signature (place, date and signature)

Write the place and date, then sign. For a minor, the legal representative signs.

4 Arbeitgeber/-in (the employer)

The employer enters their name and Betriebsnummer, the date the request arrived ('ist am … bei mir eingegangen') and the date the exemption applies from ('wirkt ab dem'), both as TTMMJJJJ. They then add the place and date and sign.

5 Hinweis (note for the employer)

The form is kept with the payroll records under § 8 Abs. 2 Nr. 4a BVV and is not sent to the Minijob-Zentrale.

Common mistakes to avoid

  • Sending the form to the Minijob-Zentrale. The notice on it says the employer keeps it.
  • Opting out without reading the leaflet. You then earn only part-months towards qualifying periods, and only part of your pay counts towards your pension.
  • Not telling your other mini-job employers. The exemption applies to all of your simultaneous mini-jobs.
  • An employer reporting the exemption late. If it isn't reported within 6 weeks of receipt, the exemption starts later.
  • Setting an exemption date before the month the request arrived. It can't apply to the past.

After you fill it out

The employer reports the exemption to the Minijob-Zentrale. After that, only the employer's flat-rate contribution is paid.
