LPA Form 1 (2022) — Lasting Power of Attorney, hardcopy form (Singapore)

What is LPA Form 1?

LPA Form 1 is Singapore's standard Lasting Power of Attorney, published by the Office of the Public Guardian (OPG) under the Ministry of Social and Family Development (MSF). It lets you, the Donor, appoint one or two people you trust — your Donees — and, if you wish, a Replacement Donee, to make decisions about your personal welfare, your property and affairs, or both, if you ever lose mental capacity. Form 1 grants general powers with basic restrictions; people who want customised powers use LPA Form 2, which a lawyer must draft.

Most people now make their LPA on OPG Online (OPGO) with Singpass. The hardcopy Form 1 is accepted only in exceptional cases, and only with the Public Guardian's approval: when the Donor, a Donee or the Replacement Donee cannot use OPGO because of a physical disability or other circumstances; when OPGO is unavailable; when the Donor has no device to receive SMS messages for Singpass; or when the Donor, a Donee or the Replacement Donee is not eligible for Singpass. The printed file begins with a cover letter explaining which of these applies. If none of them fits your situation, use OPGO instead.

Who needs to fill out LPA Form 1?

• Adults aged 21 or over in Singapore who want to choose, in advance, who will make decisions for them if they lose mental capacity through illness, injury or dementia.
• Donors who cannot make an LPA online because they, a Donee or the Replacement Donee cannot use OPGO due to a physical disability or other circumstances.
• Donors who have no electronic device to receive SMS messages to create and access a Singpass account.
• Donors whose chosen Donee or Replacement Donee is not eligible for Singpass — for example a relative living overseas without a Singapore ID.
• Families helping an ageing parent put an LPA in place while the parent can still understand and make the decision themselves.
• Anyone whose LPA attempt on OPGO failed because the system was unavailable, and who needs to proceed on paper.

When to use LPA Form 1

• While you still have mental capacity: an LPA cannot be made for someone who has already lost it — their family would need to apply to the court for a Deputyship order instead.
• Only after checking that one of the four hardcopy exceptions applies; otherwise the OPG expects the application to be made on OPGO.
• When you want to replace a previous LPA: by signing section 7 you revoke any earlier LPA from the date this one is registered.
• After a major life change — marriage, divorce, a Donee becoming unable to act, or a move into care — when your existing arrangements no longer fit.
• Leave enough time: after you sign page 11 before your Certificate Issuer, the complete form must reach the OPG for registration within 6 months.

What you need before you start

• Your full name exactly as on your NRIC, FIN card or passport, your ID number, date of birth, contact number and local mailing address.
• The same particulars for each Donee (up to two) and the Replacement Donee, if any, plus their relationship to you.
• A decision on which powers each Donee gets: personal welfare, property and affairs, or both.
• Your answers to section 4: medical treatment and clinical trials, whether the Court's approval is needed to deal with your home, and whether cash gifts are allowed and up to what yearly amount.
• The reason you are using the hardcopy form, and supporting documents such as a medical report proving a physical disability.
• A witness aged 21 or over for each Donee's signature who is not the Donor, a Donee or the Replacement Donee.
• An appointment with an LPA Certificate Issuer — an accredited doctor, a psychiatrist or a practising lawyer — who charges a professional fee.
• Photocopies of your own and your Donees' NRIC, FIN card or passport to post with the form.

How to fill out LPA Form 1, step by step

1 Cover Letter for Hardcopy LPA Forms

Part A is addressed to the Public Guardian. You give your name and the last four characters of your NRIC, FIN or passport number, then tick every reason that applies: a physical disability or other circumstance that stops the Donor, a Donee or the Replacement Donee using OPGO (with brief details); OPGO being unavailable on a given date and time; no device to receive Singpass SMS messages; or someone not being eligible for Singpass. Where the letter says 'Donor/Donee/Replacement Donee*', cross out by hand whoever it does not apply to.

In part B you sign and date the statement that your request is subject to the Public Guardian's approval. In part C your Certificate Issuer confirms the exceptional situation, with their name, MCR or AAS number, signature and professional stamp. 2 Important Information you must read (page 1)

Page 1 explains what an LPA does, that your Donees must be 21 or over and act in your best interests under the Mental Capacity Act Code of Practice, and the examples of personal welfare and property and affairs decisions. It also explains when a Replacement Donee steps in, that you must sign every page, and that your Donees sign pages 8 to 10. There is nothing to fill in, but everyone who signs later confirms they have read it.

3 Section 1: Particulars of Donor

Your full name as in your NRIC, FIN or passport, the ID number, date of birth, email address, contact number and local mailing address with floor, unit and postal code. The ID number, date, phone and postal code are written one character per box; FileIt fills those boxes for you and checks the NRIC or FIN format and the 6-digit postal code.

4 Section 2.1 and 2.2: Particulars of Donee 1 and Donee 2

The same particulars for each Donee, plus their relationship to you. Then tick what each Donee may decide: personal welfare (where you live, day-to-day care, your mail, who you see, healthcare), property and affairs (property, bank accounts, CPF monies, household expenses), or both. Section 2.2 is completed only if you want a second Donee.

Choose people you know well and trust. A Donee given property and affairs powers must not be an undischarged bankrupt, and before acting a Donee must obtain a medical report certifying that you lack mental capacity.

5 Section 3.1: Particulars of Replacement Donee

Optional. A Replacement Donee takes over if a Donee disclaims the appointment, passes on or loses mental capacity, is made bankrupt (for property and affairs powers) or divorces you. After their particulars, a small table asks which Donee they replace and in which powers. Tick only powers that the Donee actually holds; FileIt copies the Donees' names into the table.

6 Section 4: Powers granted to Donee(s)

For personal welfare: whether your Donees may give or refuse consent to start or continue treatments, including clinical trials, and — if two Donees share welfare powers — whether they act jointly and severally (either can decide) or jointly (both must agree). For property and affairs: whether the Donees must seek the Court's approval before selling, transferring or mortgaging your residential property (with its address if yes), whether they may make cash gifts from your assets (no, unrestricted, or up to a yearly limit), and how two Donees with these powers should act.

FileIt shows only the questions that match the powers you granted and leaves the rest blank on the form. Page 7 lists supporting powers, such as signing deeds and obtaining information from CPF and banks, that apply automatically.

7 Sections 5.1, 5.2 and 6.1: Statements and signatures by the Donees

Each Donee, and the Replacement Donee, reads the statement on their own page and signs and dates it in front of a witness. They confirm they are 21 or over, are not an undischarged bankrupt where they hold property and affairs powers, understand a Donee's duties, will tell the Public Guardian within 14 days if their appointment ends, and consent to be appointed. The date must be on or before the Certificate Issuer's date on page 12.

The witness must be at least 21 and cannot be the Donor, a Donee or the Replacement Donee. Their name and ID number go beside the signature box, with a tick if they translated the form into Mandarin, Malay, Tamil or another language.

8 Section 7: Statement and signature by Donor

You sign page 11 in front of your Certificate Issuer, who signs as your witness, delivering the LPA as a deed. You confirm that you intend the Donees to act if you lack mental capacity, that you are 21 or over, and that you revoke any previous LPA once this one is registered. If someone translated the form for you, the translator (aged 21 or over) signs here and gives their name, ID number and the language.

9 Section 8: LPA Certificate

Filled in by the Certificate Issuer: their name, MCR or AAS number, clinic or legal practice, and which kind of Certificate Issuer they are. They certify that you understand the LPA, that no fraud or undue pressure is involved, that you appeared before them in person in Singapore, and that they witnessed your signature. They must be independent of you and your Donees. Their date must be on or after yours on page 11, and they add their professional stamp.

Common mistakes to avoid

• Using the hardcopy form when no exception applies. The Public Guardian must approve a paper application, so check the four situations on the cover letter first.
• Forgetting to sign every page. The Donor's box is at the bottom right of each page, including the pages the Donees complete.
• Signing in the wrong order. Donees sign before the Certificate Issuer's date, you sign page 11 in front of the Certificate Issuer, and the Certificate Issuer's date must be the same as or later than yours.
• Choosing an ineligible witness. A Donee's witness must be 21 or over and cannot be the Donor, a Donee or the Replacement Donee.
• Ticking Replacement Donee powers that the Donee being replaced does not have, or leaving section 4 questions unanswered for the powers you did grant.
• Posting the form late. The complete form must be submitted within 6 months of the date you sign page 11.
• Using an older edition. The OPG asks for the 2022 version of the hardcopy form and says older versions may be rejected.
• Leaving out the cover letter, supporting documents or ID photocopies, which the OPG needs to consider the application.

After you fill it out

Print the whole PDF, including the cover letter. Arrange for each Donee and the Replacement Donee to sign their page in front of an eligible witness, then visit your Certificate Issuer: you sign page 11 before them, they complete section 8 and part C of the cover letter, and you sign the bottom of every page. The 2022 form asks you to post the completed form with photocopies of your own and your Donees' NRIC, FIN card or passport to the OPG at 3 Bishan Place #03-00, CPF Bishan Building, Singapore 579838, together with the cover letter and supporting documents. Check the OPG's page before posting in case the address or requirements have changed. The OPG says no refund is given once an application is submitted, whatever the outcome.

Keep a copy of everything you send. The filled PDF stays in the Donor's folder in your FileIt vault, alongside the photocopies and any letters from the OPG, so your family can find the registered LPA when it is needed. You can revoke an LPA at any time while you still have mental capacity, using the OPG's revocation form.
