What is a private pool rental agreement?

Hourly pool rentals are an easy way to earn from a pool that sits empty most weekdays, but strangers in your backyard bring obvious questions. How many people can come? Who watches the children? Can they use the bathroom inside? Who pays if the umbrella goes in the pool? This agreement answers them for one booking.

It sets the date, start and end times and the maximum number of people, says plainly that there is no lifeguard, and requires a set ratio of supervising adults to children (or no children at all). You choose which areas and which restroom the party may use, plus parking, extras, alcohol and pet rules and any house rules of your own. The guest pays a booking fee and an optional damage deposit, under the cancellation policy you pick, and accepts the risks of swimming, with a release that applies only as far as the law allows.

Tips before you send it

  • Ask your home insurer before you rent the pool out. Many standard policies exclude paid use by the public, and you may need extra cover.
  • Check local rules too. Some places require permits, pool barriers or limits on guests for paid pool use.
  • Keep rescue equipment such as a ring buoy and reaching pole by the pool, and post the address for emergency calls.
  • Have each adult in the party sign the separate private pool guest waiver as well.

Private pool rental agreement: frequently asked questions

Does the host have to provide a lifeguard?

No. The agreement says clearly that there is no lifeguard and the host does not supervise swimmers. The guest must make sure a responsible adult who can swim is watching whenever anyone is in the water.

What happens if it rains?

Nobody swims during thunder or lightning, and the host may close the pool if the weather makes it unsafe. If the host closes it before the start time, the guest gets a full refund or another time.

Does the release protect the host completely?

No. It applies only as far as the law allows, never covers the host's own negligence or wilful misconduct, and may bind children less than adults. Insurance is the host's real protection.

Is this the same as the pool guest waiver?

No. This agreement covers the booking, the rules, payment and cancellation and is signed by the person who books. The private pool guest waiver is a shorter release for each adult swimmer.
