What is a private pool guest waiver?
Letting neighbours or friends use your pool is generous, and it helps when everyone knows the house rules before the first cannonball. Most of the serious accidents at home pools involve young children and moments when nobody was watching, or adults swimming after drinking. A short written agreement makes clear that you aren't a lifeguard and that each guest looks after their own party.
This waiver names you, the property and the guest, and covers either a single visit or every visit over a period, such as a summer. The guest lists the people they bring, with children's ages. You set the children's supervision rule and an alcohol rule (no alcohol, nobody in the water after drinking, or by agreement only), and edit a list of pool rules: no diving in the shallow end, no glass, gate latched, nobody swims alone. The guest accepts the risks for their party and releases you to the extent the law allows, and is responsible for damage beyond ordinary use. It doesn't remove your own duties around pool fencing and safety.

Using the private pool guest waiver, step by step
1 Your pool and dates
Your name fills in. Add the property, describe the pool if you like, and set the first date — plus a last date to cover a whole season.
2 Set the house rules
Edit the children's supervision rule and the pool rules, and pick the alcohol rule that suits your home.
3 Send it to the guest
The guest adds their phone and the people in their party, with children's ages, then signs on their phone.
4 Countersign and keep it
You countersign, and the signed copy is filed in your FileIt vault — handy if the same family comes back next summer.
Tips before you send it
- Talk through the rules in person as well; a form nobody remembers doesn't keep children safe.
- Keep a phone, a flotation ring and the address for emergency calls by the pool.
- Check your home insurance covers guests using the pool, and whether it requires anything specific.
- Pool fencing and gate rules are set by local law and still apply whatever the guest signs.
Sign it online in minutes
- Fill in the blanks. Names, dates and amounts go straight into the agreement — the preview shows exactly where.
- Name who signs. Tick “This is me” for your own part. FileIt builds the PDF with every signature, date box on the right line, and you can check or move anything before sending.
- Send it. Each signer gets a secure link and signs from any device — no account needed. The signed PDF, with an audit trail and a Certificate of Completion, is filed in your vault and emailed to everyone.
Private pool guest waiver: frequently asked questions
Does a signed waiver mean I can't be held responsible?
No. It releases you to the extent the law allows, and doesn't remove liability that can't be excluded, such as gross negligence in many places, or your duties around pool fencing and safety.
Who watches the children?
The guest. The form says there is no lifeguard, you aren't supervising swimmers, and children follow the supervision rule you set, watched by an adult from their own party.
Can one signature cover a whole family?
Yes. The adult guest signs and lists the people in their party. They accept the risks and the rules for everyone in it.
Can I use it for a hot tub?
Yes. Describe it in the pool field and add hot-tub rules, such as time limits and no children under a set age, to the pool rules.
