What is a pool construction contract?

An in-ground pool is a large, expensive hole until the last stage is done, and the biggest surprises are underground. Rock, groundwater or a buried septic line can change the price overnight, and in many places a pool that is finished but not fenced may not be filled. A pool construction contract deals with those risks before the digger arrives, so the homeowner knows the stages they're paying for and the builder isn't left absorbing costs nobody could have seen.

This template ties the build to the plan reference and records the pool type, whether concrete, fibreglass or vinyl liner, along with the size and depth, finishes, coping, decking and equipment. Its exclusions list is editable. It sets who handles permits, the machinery access route and where excavated soil goes. If rock or water turns up, work stops and the extra is agreed first, or the homeowner can end the contract. It covers staged payments with lien releases, written changes, temporary barriers, and who provides the permanent fence before the pool is filled. Completion includes start-up and a handover lesson, and there are separate warranties for the shell and the rest of the work.

Tips before you send it

  • Do a soil probe or check local geology before quoting. The hidden ground conditions clause works best when the homeowner was warned.
  • Agree who is building the fence before the dig. Some places won't pass a pool for filling without a compliant barrier.
  • Walk the access route with the homeowner and photograph it, so lawn and paving damage expectations are clear.
  • Give the homeowner a written water chemistry guide at handover. The warranty excludes damage from poor water balance.

Pool construction contract: frequently asked questions

What happens if the digger hits rock?

The builder stops that part of the work, shows the homeowner and explains the options. Extra work is charged as agreed in the contract, or the homeowner can end it and pay for work done.

Who is responsible for the pool fence?

You choose: the homeowner arranges it, the builder installs it, or an automatic safety cover is relied on where local rules allow. The pool isn't filled or used until the requirements are met.

Is lawn damage covered?

Some damage along the agreed access route is unavoidable and restoration isn't included unless listed. The builder repairs damage it carelessly causes to structures, fences and hard surfaces outside the route.

What do the warranties cover?

A structural warranty on the shell and a workmanship warranty on plumbing, electrical connections, tile, coping and decking. Equipment carries the manufacturers' warranties.

Is the template free?

Yes. It's free with FileIt eSignature, and the homeowner signs from the email link without an account.
