ID 407E Hong Kong Helper Contract Termination: Fill Online

What is Form ID 407E (FDH contract termination notice)?

When the standard Employment Contract (ID 407) between a Hong Kong employer and a foreign domestic helper ends early, the Director of Immigration has to be told. Form ID 407E is that notification. The employer and the helper may use the same form or each send their own, and it can be made online via GovHK, faxed, posted or delivered to the Immigration Department.

The form asks for the visa reference and the employment contract number, the employer's and the helper's names, identity card numbers, telephone numbers and e-mail addresses, the contract termination date (normally the last working day) and each side's reason for the termination. The notes remind both parties to observe Clauses 10, 11 and 12 of the contract, and that the helper has to leave Hong Kong within 14 days of the termination or before the limit of stay expires, whichever is earlier.

1 Date and who is notifying

The date of the notification, then the sentence '* I/We hereby inform you that the Employment Contract with details below * was/will be terminated'. Choose whether one party (I) or both (We) are notifying, and whether the contract has already ended or will end. 2 Visa reference and contract number

Copy the Application Reference No. from the helper's visa into the four groups of boxes, and the contract number from the ID 407 employment contract.

3 Employer's information

The employer's name, Hong Kong Identity Card number, daytime telephone number and e-mail address. ImmD may send its written acknowledgment by e-mail.

4 Employee's information

The helper's name, Hong Kong Identity Card number, daytime telephone number and e-mail address.

5 Termination date and reasons

The exact contract termination date, normally the last working day, and the reason for termination in the employer's column and/or the employee's column. Continue on a separate sheet if needed.

6 Signature

Signed by the employer and/or the employee. The form says the signature should agree with the one on the employment contract.

Common mistakes to avoid

Giving an approximate termination date: the form asks for the exact date.
Signing differently from the signature on the employment contract.
Posting the original after already submitting online or by fax: the form asks you not to.
Forgetting that the helper has to leave Hong Kong within 14 days of the termination or before the limit of stay expires, whichever is earlier.
Leaving the visa reference blank: it is on the helper's visa.
