What is MP-1 bis (birth and childcare benefit, birth)?

MP-1 bis (Solicitud de prestación por nacimiento y cuidado de menor por parto) is the application to Spain's National Social Security Institute, the Instituto Nacional de la Seguridad Social (INSS), for the birth and childcare benefit — the payment during the leave that follows a birth, formerly known as maternity and paternity benefit. It is used by the biological mother or by the other parent.

The form asks for your identity and address, the other parent's details, any legal or voluntary representative, the birth (or surrogacy), whether the Basic Statute of Public Employees applies to you, when you take your leave, the special subsidy for a multiple birth, your tax residence, your bank account and three consents. The INSS says it has 30 days from registration to decide and notify, and that all notifications about this benefit are made electronically in the Social Security electronic office.

Who needs to fill out MP-1 bis (birth and childcare benefit, birth)?

  • Biological mothers taking leave after, or starting before, the birth of their child.
  • The other parent taking their own birth and childcare leave.
  • Parents of a child born through surrogacy, with the filiation registered in Spain or recognised by a final Spanish court ruling.
  • Parents of twins or more who want the special subsidy for a multiple birth.
  • Legal or voluntary representatives applying on a parent's behalf.

When to use MP-1 bis (birth and childcare benefit, birth)

  • After the birth, to claim the benefit for the leave you take.
  • Before the birth, when the biological mother starts her leave early — the form's note allows up to four weeks before the expected date for workers under the Workers' Statute.
  • When you want to take the benefit in more than one period, together with the separate 'Disfrute en múltiples períodos' form from www.seg-social.es.

What you need before you start

  • Your DNI, or for foreign nationals a passport or national ID plus NIE, or your TIE.
  • Your Social Security number and full address.
  • The other parent's name, document and Social Security number (required with two or more children, or when the EBEP applies).
  • The date of birth and number of children born, and any disability certificate or medical report.
  • The dates of the leave you want to take.
  • Your IBAN, for an account in your name.
  • Employees: your employer sends the company certificate through the Sistema RED. Other documents, such as the maternity report or family book, are listed on the form's documents page.

How to fill out MP-1 bis (birth and childcare benefit, birth), step by step

1 1) Datos personales (personal details)

Say whether you are the biological mother or the other parent, then your name, date of birth, sex, document, Social Security number, nationality, address and contacts. Part 1.2 is the other parent; parts 1.3 and 1.4 are only for a legal or voluntary representative applying for you.

2 2) Motivo de la solicitud (reason)

Birth or surrogacy, the date of the birth, how many children were born and how many with a disability, whether there is a disability certificate (and its degree, or when you applied for it), and whether you are a single-parent family.

3 3) Normativa aplicable (EBEP)

Say whether the Basic Statute of Public Employees applies to you. The form notes it also applies, for this purpose, to employees under a labour contract working for a public administration.

4 4) Modalidad de disfrute (your leave)

4.1 is only for the biological mother starting leave before the birth: the start date and the expected date of birth. 4.2 is the leave you take: start and end dates, and whether you want more than one period. The six weeks after the birth must be taken full time without a break, and the instructions warn that the period can't be changed once recognised.

5 5) Parto múltiple (multiple birth)

Say whether you will take the special subsidy for a multiple birth. If both parents work, they agree who receives it on the separate agreement form.

6 6) Otros datos (tax and language)

Your province of tax residence. The instructions say the benefit is exempt from IRPF withholding in the common and Basque territories; in Navarre you can choose the general table, the pensioners' table or a voluntary rate. You can also ask for letters in a co-official language.

7 7) Datos bancarios (bank details)

Whose name the account is in, and the IBAN. A wrong or missing account prevents payment.

8 8-9) Consents, date and signature

Consent to electronic processing, whether the INSS may consult your data held by other administrations (if not, you provide the documents), and whether it may contact you by mobile and e-mail. Then the place, date and signature — not needed if you file online.

Common mistakes to avoid

  • Giving an account that isn't in the applicant's name.
  • Mistyping the IBAN; the form warns a wrong account prevents payment.
  • Leaving out the other parent's details when two or more children were born or the EBEP applies.
  • Choosing leave before the birth as the other parent; part 4.1 is for the biological mother only.
  • Asking for dates you may want to change later; the recognised period can't be modified.
  • Refusing the data-consultation consent without then providing the documents within 10 working days.
