What is a land survey services agreement?

A land survey services agreement is the engagement letter between a land surveyor and the person ordering a survey — usually an owner checking a boundary before building a fence or extension, a buyer and their lender before closing, or a builder setting out a new house. It matters because a survey is a professional opinion prepared for a specific purpose, and because it is often relied on by people other than the client.

This template covers the survey type (boundary, topographic, combined, site plan for a permit, or construction setting-out), its purpose and any extra items, records research and fieldwork, whether markers are set, access to the property and neighbouring land, deliverables and timing, and what a survey does not show — it is not a title search, and buried utilities and boundary disputes are flagged rather than resolved. It sets a fixed fee or hourly estimate, deposit, who may rely on the survey (such as a named lender or title company), copyright, liability and cancellation.

Using the land survey services agreement, step by step

1 Describe the property and survey

Enter the address and any parcel or lot reference, pick the survey type and say what it is for. Add any extra items such as trees or floor levels.

2 Decide on markers and deliverables

Choose whether missing corner markers are set, and list the deliverables — signed plan, paper copies, CAD data — with a delivery time after fieldwork.

3 Set the fee and reliance

Choose a fixed fee or an hourly estimate, add any deposit, and name any lender or title company that may rely on the survey.

4 Send for signature

Add the client as a signer and send. Both of you initial each page; the signed agreement is filed in your vault.

Tips before you send it

  • Ask the client for their deed, title report and any earlier survey — the agreement asks them to provide these.
  • Be specific about the purpose; a survey prepared for a fence may not suit a lender or a subdivision.
  • Tell neighbours before fieldwork near shared boundaries — it avoids most access problems.
  • Rules on markers, recording and survey content vary by place; the agreement follows the standards that apply where the land is.

Land survey services agreement: frequently asked questions

Does a boundary survey prove who owns the land?

No. The survey shows the surveyor's professional opinion of where the boundaries lie. It is not a title search and does not decide ownership or other people's rights over the land.

What happens if the survey finds an encroachment?

The surveyor shows or reports it. Resolving it may need agreement with the neighbour, legal advice or a court, which is outside the survey.

Can my lender rely on the survey?

Yes, if you name the lender (or title company) in the agreement. Anyone else needs the surveyor's written consent.

Is a document signed electronically legally binding?

In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary agreement like this one. FileIt keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.

Is this template free?

Yes. The template is free to use with the eSignature app in FileIt. Your client doesn't need a FileIt account to sign.
