What is a hOA violation notice?

Associations get into trouble less for enforcing rules than for enforcing them unevenly or skipping steps. A consistent written notice, with the rule cited, the facts stated plainly, a reasonable date to fix it and a clear route to be heard, protects the board as much as it informs the owner.

This template lets you mark the stage, from courtesy reminder to final notice before fines, name the covenant or rule, describe what was observed and list earlier notices. It sets what must be done and by when, invites a request for more time, states any fine your schedule allows, or says further steps may follow if none is set, and gives the owner a set number of days to ask for a hearing, with no fine before it takes place. The owner signs to confirm receipt only.

Using the hOA violation notice, step by step

1 Identify the owner

Enter the association, the owner and the lot or unit address.

2 Describe the violation

Choose the notice stage, cite the rule or covenant, describe what was seen with dates and list any earlier notices. Attach photos.

3 Set the fix and fines

Say what the owner must do and by when. Add a fine only if your schedule allows it, and how often it applies.

4 Offer a hearing and send

Set the days to request a hearing and a contact, then sign and send. FileIt records when the owner opened and acknowledged it.

Tips before you send it

  • Read your CC&Rs, bylaws and state law on notice and hearings before the first notice, and follow the same steps for every owner.
  • Use neutral, factual wording and dated photos rather than descriptions like "eyesore".
  • Start with a courtesy reminder for minor first-time issues; most are fixed without fines.
  • Keep each notice and the owner's reply in a vault folder per lot, so the history is easy to show at a hearing.

HOA violation notice: frequently asked questions

Can the association fine an owner straight away?

It depends on your governing documents and local law. The template states fines only as the documents allow, offers a hearing first and says no fine is imposed before a requested hearing.

Does signing mean the owner admits the violation?

No. The acknowledgement says signing confirms receipt only and is not an admission.

What if the owner needs more time?

The notice invites them to contact the association before the deadline and says reasonable requests will be considered.

Can an HOA send violation notices electronically?

Many associations do, and FileIt records delivery and signing. Some governing documents or state laws require mailed notice or the owner's consent to electronic notice, so check yours.
