What is EP1PG Notice of intention to register an EPA?

An Enduring Power of Attorney (EPA) is the older kind of power of attorney: new ones couldn't be made after October 2007, but an EPA made before then can still be used. When the attorney believes the donor is becoming, or has become, mentally incapable, the EPA must be registered with the Office of the Public Guardian (OPG) before it can be used, or go on being used.

Before applying, the attorneys must give notice on form EP1PG to the donor personally and to at least three of the donor's relatives, in the order of priority OPG's guide sets out, and to any attorney appointed jointly and severally who isn't applying. The notice says who is applying and about which EPA, and explains the grounds and the five-week time limit for objecting.

FileIt fills in OPG's own EP1PG (08.13 edition) for one person at a time, with accented names printed correctly. Make one for each person you must notify, and keep a record of the date you give each one: you'll need the dates for the application, form EP2PG. FileIt never sends anything for you.

1 Who the notice is for

The name and address of the person you're giving this copy to: the donor, a relative or a co-attorney.

2 The attorneys

Your name and address, and a second applying attorney's if there is one. The form may be adapted for three or more attorneys.

3 The donor and the EPA

The donor's name and address, and the date the donor made the EPA (Part B of the EPA). EPAs could only be made before 1 October 2007, so FileIt checks the date.

Common mistakes to avoid

  • Notifying only some relatives in a class: OPG's guide says that if one person in a category is notified, everyone in that category must be.
  • Counting a relative under 18 among the three relatives who must be notified.
  • Posting the donor's notice: it must be given to the donor personally.
  • Not recording the date each notice was given, which EP2PG asks for.

After you fill it out

Print one copy for each person, sign and date it (by hand or with FileIt's eSignature), and give or send it to them yourself.

Record the date each notice was given.

Then apply to register on form EP2PG with the original EPA and the fee.

Keep copies of every notice in your FileIt vault.
