What is the trademark application intake form template?
A trademark application looks short, but the details matter. The owner has to be named correctly. The mark has to be shown exactly as used. The goods and services have to be described in a way that fits the right classes. And if the mark is already in use, the attorney needs a date and real proof of use.
This template collects those details in four pages. It starts with the owner — its exact legal name, entity type, where it's organised and its address — then the mark itself. Words-only marks are typed exactly as written. Logos are uploaded, with an optional colour note. The client describes what they sell in plain words and ticks the broad areas it covers.
The key branch is "Is the mark already in use?" A yes asks for the date of first use and a specimen upload, such as a product label or the page where customers buy. A no asks for a planned launch date. Every intake is filed as a PDF in your FileIt vault, with the logo and specimen attached.

The trademark application intake form, page by page
1 Owner & contact
The contact's name, role, email and phone. "Who will own the mark?" asks for the exact legal name, with the owner type, where it's organised and its address.
2 The mark
"What would you like to register?" — words only, a logo without words, or a logo with words. Words ask for "The mark, exactly as written". Logos require an upload and ask whether colours matter. Any meaning or translation, and whether the client has already searched for similar marks, round it off.
3 Goods & services
A plain-language description of what's sold or planned, a checklist of broad areas from clothing to software, anything planned for the next few years, and a website.
4 Use & countries
"Is the mark already in use?" Yes requires the date of first use and a specimen upload, and asks for the first sale across state lines or abroad. No asks when use will start. Then the countries where protection is wanted, any objections received, deadlines, and a consent that the form doesn't file anything.
Make the template yours
- Replace the broad areas with the classes you file in most often
- Add your fixed fees per class to the cover text
- Remove the second first-use date if you only file outside the US
- Ask for a second contact if larger clients have an in-house lawyer
- File intakes to a folder for each client
- Add the paralegal who runs searches to the notification emails
Tips for a better trademark application intake form
- Check the owner's legal name against the state register before drafting
- Look at the specimen early; a weak one is easier to replace before filing
- Use the planned additions to talk about how wide the description should be
- Ask about objections up front — they often change the advice
Every response becomes a PDF in your vault
The intake is filed as a PDF in the vault folder you choose, with the logo and specimens attached as files, and you're notified by email. The client receives a copy of their answers.
The Responses table lets you see new instructions at a glance and export them to CSV for your docketing. Submitting doesn't file anything with any trademark office.
- Start from this template. It opens in the FileIt Forms designer — change any question, add pages, set the rules for when questions appear.
- Share it. Turn on a public link, or send it to people by email, each with their own link. They don’t need a FileIt account.
- Get the answers as PDFs. Each response is saved as a PDF in the vault folder you choose, with uploaded files attached — and listed in a Responses table you can export to CSV.
Trademark application intake form: frequently asked questions
Is this trademark intake template free?
Yes. It's included with FileIt's Forms app on every plan, including free.
Does the form file a trademark application?
No. It collects information for the attorney. Nothing is sent to any trademark office.
What kind of logo file can clients upload?
PNG, JPEG or PDF, up to three files. You can change the allowed types in the designer.
Why ask whether the mark is already in use?
Applications often differ depending on whether a mark is in use, so the form asks for first-use dates and a specimen only when they apply.
Do clients need a FileIt account?
No. They open the link and submit.
How is this different from the trademark use request template?
That one is for people asking permission to use your brand. This one is for registering a new mark.
