What is a seasonal sales lot lease?
Christmas tree lots, pumpkin patches and other seasonal sales need a visible spot for a few weeks a year, and plenty of landowners have one: a corner of a shopping centre car park, a church lot, a vacant parcel on a busy road. The arrangement only works if both sides know exactly where the vendor can set up, what they pay, what happens to power and toilets, and who removes the straw and netting in January.
This agreement grants a temporary licence over a defined sales area for the products you name, with set-up, sales and clear-by dates and opening hours. It sets a season fee payable up front, in two halves or weekly, plus an optional share of gross sales and a clean-up deposit. You choose how power, water, toilets and overnight security are handled. The vendor takes care of permits, safe structures and signs, keeps fire lanes and entrances clear, carries liability insurance at the level you set, and must clear everything, including unsold stock, by the clear-by date. In return the landowner hands over a clear area, keeps the entrances open and won't let a competing seller of the same products onto the lot.

- Ask the vendor for copies of their permits and insurance certificate before set-up day.
- A clean-up deposit is the simplest way to make sure the lot really is cleared on time.
- Save the signed agreement in FileIt with the clear-by date as its expiry date, and a reminder to inspect the lot that day.

Seasonal sales lot lease: frequently asked questions
Is this a lease of the land?
No. It is a temporary licence to use a defined sales area for the season and creates no lease or lasting right to the land.
Does the vendor get money back if the weather is bad?
No. The fee isn't refundable for poor weather or slow sales. It is reduced in proportion only if the landowner can't provide the sales area for part of the season through no fault of the vendor.
Can the vendor stay on the lot overnight?
Only if you choose the option allowing one staffed trailer for security. Otherwise nobody may stay overnight.
What if unsold trees are left behind?
The vendor must remove all stock and debris by the clear-by date. If not, the landowner may clear it at the vendor's cost, using the clean-up deposit if there is one.
