What is a medical director agreement?

Med spas, IV hydration bars and wellness clinics often offer treatments that the law treats as medical: injectables, infusions, lasers, prescription skincare. Depending on where you operate, those may need a physician's order, examination, delegation or supervision, and a named medical director who is responsible for the clinical side. The rules differ a great deal from place to place, so this agreement is built around them: where local law asks for more, the law wins.

The template lists the services and locations the medical director oversees, and what they do: write or approve protocols and standing orders, sign off staff competency, handle required examinations, review charts at the rate you set, spend agreed time on site and answer urgent calls within a set time, with a covering physician when they're away. The practice commits to licensed staff, consent and records, proper sourcing of products and prompt reporting of adverse events. It covers independent medical judgement, a fixed monthly fee that doesn't depend on referrals or revenue, professional liability insurance, licence notices, patient privacy, and what happens when the role ends.

Using the medical director agreement, step by step

1 List the services and locations

Name every treatment that needs physician oversight and every site, including mobile visits. Anything not listed is outside the role.

2 Set the oversight level

Enter the chart review rate, the on-site time and how fast urgent calls are answered. Check whether local rules set minimums.

3 Agree the fee and insurance

Enter a fixed monthly fee, an optional hourly rate for extra work, and choose who provides professional liability cover for the role.

4 Send it for signature

Sign for the practice and send it to the physician. The signed agreement is filed in your FileIt vault, alongside the licences you track for expiry.

Tips before you send it

  • Have a local healthcare lawyer check who may own the practice and who may perform each treatment before you sign — this varies more than almost anything else in this field.
  • Keep the fee fixed. Tying it to patient numbers or revenue can raise problems under referral and fee-splitting rules in many places.
  • Track the medical director's licence expiry in FileIt and diary the annual protocol review.
  • Keep written sign-offs of each staff member's competency — they are often the first thing an inspector asks for.

Sign it online in minutes

Medical director agreement: frequently asked questions

Does every med spa need a medical director?

Not everywhere, and the answer depends on the treatments offered and local law. Many places require physician oversight for injectables, IV therapy, prescription products and some lasers. This template doesn't decide that for you; it says that local rules apply and adds to them.

Can the medical director stop a treatment?

Yes. Section 5 lets the medical director suspend a service, or stop a staff member performing it, where they reasonably believe patient safety requires it, with written reasons.

What happens when the agreement ends?

The practice must stop services that need a medical director's oversight until a new one is in place, and update any registrations naming the outgoing physician, who hands over protocols and records of staff sign-offs.

Can it be signed electronically?

In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an agreement like this one. FileIt keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.

Is this template free?

Yes. The template is free to use with the eSignature app in FileIt, and the people you send it to don't need a FileIt account to sign.
