What is a expert witness agreement?

An expert's value in litigation depends on independence. A fee that rises or falls with the opinion, or a retaining lawyer who pushes for a different conclusion, can undermine the evidence and the expert's reputation. A clear retention agreement protects both: the expert is paid for time, whatever the opinion, and the lawyer knows the rates, the rules and what happens if a trial date moves.

This template identifies the expert's field, the retaining firm or party, the client represented, the matter and the other parties for the conflict check. It sets the subject of the work and whether the expert consults, testifies or may later be designated. It covers the retainer and how it is applied, hourly rates for review, report writing and testimony, minimum testimony days, travel time, late cancellation of reserved dates, depositions paid by other parties, expenses and invoicing. It states the expert's independence and court duties, conflicts, confidentiality and protective orders, the possibility that expert materials are disclosable, and ending the engagement.

Tips before you send it

  • Run the conflict check against every party and law firm before signing. The agreement records the list it was based on.
  • Ask the lawyer which procedural rules apply to experts in the court or tribunal. They can affect reports, disclosure and the expert's duties.
  • Treat everything you write as potentially disclosable if you may testify. The agreement flags this.
  • Agree how deposition fees will be collected when the other side takes the deposition, especially in places where they pay.

Expert witness agreement: frequently asked questions

Can the expert's fee depend on winning?

No. The agreement says the fee is for time and payable whatever the opinion or outcome. A fee that depends on the outcome can damage credibility and is restricted or prohibited by court and professional rules in many places.

Who pays if the client doesn't?

Where a law firm retains the expert, the firm is responsible for the fees whether or not the client reimburses it.

What if the trial date is cancelled at the last minute?

Reserved testimony time cancelled with less than the notice you set is charged at the testimony rate, unless the expert can use the time for other paid work.

Does the expert owe a duty to the court?

Many courts and tribunals impose duties on experts that override their duty to the retaining party. The agreement says the expert will comply with them.

Can it be signed electronically?

Yes. E-signatures are generally valid for professional engagement agreements like this in the US, UK, EU and Canada. FileIt keeps an audit trail with the signed PDF.
