What is a concession stand agreement?

Sports clubs, parks, swimming pools, schools and event venues often let an outside operator run the concession stand: burgers on match days, ice cream by the pool, club merchandise at the gate. It can be a welcome source of income and a better experience for visitors, but only if everyone knows when the stand must be open, what it may sell, how the venue gets paid, and who is responsible for food safety and the mess at the end of the day.

This template grants a seasonal licence to use a named site, not a lease, for food and drink, alcohol, merchandise or a mix, with optional exclusivity. It fixes the approved menu, whether prices need approval, and minimum opening hours tied to your event schedule. You choose a fixed fee, a percentage of gross sales or the greater of the two, with monthly sales reports and an optional security deposit. The operator holds its own permits, follows food hygiene rules, handles waste properly, follows your safeguarding policy around children and carries liability insurance. Venue equipment, utilities, suspension for safety, early ending and end-of-season clear-out are all covered.

Tips before you send it

  • Food business registration, health inspections and temporary event permits differ by place. Ask the operator to show you theirs before the first day of trading.
  • If alcohol is involved, check whose licence covers the sales and what conditions it carries.
  • A percentage of sales fee only works with reliable till records. The template requires a till or card system and monthly reports.
  • Walk the site with the operator before the season and note the condition of the equipment you provide. It makes the end-of-season return easier.

Concession stand agreement: frequently asked questions

Is a concession agreement a lease?

No. The template grants a licence to use the site for the concession during the season. The venue keeps control and can enter the site at reasonable times.

How is a percentage of sales calculated?

On gross sales from the site, including card and online orders collected there, excluding sales tax, tips passed to staff and refunds actually given.

Can the venue close the stand?

It can suspend trading at once if food safety, fire safety or people's safety is at risk, until the problem is fixed, and either side can end the agreement for a serious breach that is not fixed within 7 days.

Who provides the fridges and counters?

Whatever the venue lists is provided for the operator to use and return in good condition. Anything else the operator brings stays its property and at its own risk.
