What is Form RX1 (enter a restriction)?

A restriction is an entry in the proprietorship register of a title that stops a sale, mortgage or other disposition from being registered unless its terms are met: for example that capital money is paid to at least two trustees (Form A), that a named person consents, or that notice is given to them. People use restrictions to protect a share in a property held on trust, to record a declaration of trust between co-owners, or to protect an interest that isn't shown on the register.

Form RX1 is the application. It names the property and title, says whether the restriction affects the whole estate, part of it or a registered charge, explains why the applicant is entitled to apply (as owner, with consent, or with some other sufficient interest), and sets out the restriction's exact wording, using a standard form from Schedule 4 to the Land Registration Rules 2003 where one fits.

FileIt takes you through every panel, shows only the parts your answers need, and prints them onto HM Land Registry's own RX1 PDF. For a non-standard restriction it also strikes through the '[in standard form]' words for you. You sign the printed form and send it with the fee. FileIt doesn't send it for you.

  • Co-owners who hold as tenants in common and want a Form A restriction recorded.
  • Someone who contributed to buying a home in another person's name and wants to protect their beneficial interest.
  • Owners who want a restriction requiring their own consent or certificate before a sale or mortgage, for example to guard against property fraud.

  • When the register should show that a sale or mortgage needs a consent, a certificate or notice to someone.
  • On its own, or alongside an AP1 or FR1 application.
  • When the land is already registered at HM Land Registry.

  • Whether it affects the whole title, part of it (with a plan) or a registered charge, with the charge's date and lender.

  • Any consents or evidence, listed in panel 5, and the fee.

How to fill out Form RX1 (enter a restriction), step by step

1 Panels 1 to 3: Property

Local authority, title numbers, the property, and whether the restriction affects the whole, part or a registered charge.

2 Panel 4: Fee

The fee for entry of the restriction, and cheque or direct debit.

3 Panels 5 to 7: Documents and people

The documents you're sending, the applicant's names, and who is sending the application. Panel 7 must always be completed.

4 Panel 8: Entitlement

Pick the one statement that applies. For 'other sufficient interest', panel 12 (by you) or panel 13 (by your conveyancer) explains the interest and how it arose.

5 Panel 9: Wording

The restriction in full, with the standard form letter when it's a standard restriction.

6 Panels 10 and 11: Signatures and consent

The date, then the applicant or conveyancer signs. Anyone consenting on the form prints their name in panel 11 and signs beside it.

Common mistakes to avoid

  • Ticking more than one statement in panel 8.
  • Giving only a standard form letter when the restriction has variable wording. The wording must be set out in full.
  • Leaving out addresses for service when the restriction needs a consent, a certificate or notice.
  • Applying without reasonable cause. Section 77 of the Land Registration Act 2002 can make you liable for damages.
  • Sending original documents when certified copies would do. HM Land Registry destroys them after copying.

After you fill it out

Print the form. The applicant or their conveyancer signs panel 10, and any consenting proprietors sign panel 11.

Send it to HM Land Registry with the fee and the documents listed in panel 5.

HM Land Registry may send requisitions to the address or email in panel 7. Once registered, the restriction appears in the proprietorship register.

Keep the filled RX1 and the updated register in FileIt with the property's papers.

Form RX1 (enter a restriction): frequently asked questions

What's a Form A restriction?

It's the standard restriction that stops a sole surviving owner from selling on their own, so capital money must be paid to at least two trustees or a trust corporation. It's commonly entered when co-owners hold as tenants in common.

Do I have to use a standard form of restriction?

No, but the standard forms in Schedule 4 to the Land Registration Rules 2003 are usually quicker. For a non-standard restriction, the registrar must consider it reasonable. Practice guide 19 explains both.

Can I apply for a restriction on someone else's property?

Only with a sufficient interest, such as a beneficial interest under a trust, explained in panel 12 or certified by a conveyancer in panel 13. Applying without reasonable cause can make you liable for damages.

Who signs the RX1?

If a conveyancer is acting, they sign. Otherwise the applicant signs, and every applicant if there's more than one. A conveyancer who gives one of the panel 8 certificates must sign.

Can I apply online?

Conveyancers can use HM Land Registry's portal (e-RX1). Others usually post the paper form.
