What is a unmarried couple separation agreement?

When an unmarried couple separates, there's usually no court process to divide things up — just a shared flat, a joint account, a sofa on finance, a cat and two people trying to be fair to each other. Writing it down avoids arguments later about who promised what, and stops either person being caught by a joint bill they thought was dealt with.

This agreement records the separation date and what happens to the home: one partner takes over the lease, both leave, or an owned home is dealt with as you describe. It sets the move-out date, deposit and final bills, lists who keeps which belongings, and covers joint accounts, shared debts (with an indemnity), any settlement payment and pets. Once done, it's a full and final settlement of financial claims between you, so far as the law allows — but never of anything to do with children. Both partners initial every page.

Tips before you send it

  • Each take independent legal advice — especially if there's an owned home, significant savings or a pension involved.
  • Tell the landlord and lenders: this agreement binds the two of you, not them.
  • Change passwords and remove each other from shared subscriptions and accounts.
  • Keep arrangements for children completely separate — use a parenting plan or the co-parenting communication agreement.

Unmarried couple separation agreement: frequently asked questions

Can married couples use this?

No. Married couples and civil partners need the divorce or dissolution process where they live. This agreement is for couples who lived together without marrying.

Is it legally binding?

It's written to be, under the governing law you name. But the rights of unmarried partners vary widely, and some places require particular formalities. Both partners should consider independent legal advice.

Does it cover children?

No. The agreement says expressly that claims relating to children, including child support, are dealt with separately.

What if the landlord won't release one of us from the lease?

Both remain liable to the landlord until released. The partner who stays agrees to indemnify the other against later claims under the lease.

Can we sign without meeting?

Yes. Each partner signs and initials online on their own device. The signed PDF includes an audit trail and a Certificate of Completion.
