What is a seller rent-back agreement?
Rent-backs are common when a seller is waiting to close on their next home or the school term hasn't ended. They're also where plenty of sales go sour, because the buyer now owns a house someone else is living in and has no clear way to get it back on time.
This agreement starts at closing and ends at a fixed move-out date and time. It sets a fee per day or for the whole stay, or none, a holdback deposit kept by the closing agent and released after a joint walk-through, and who pays utilities. It covers upkeep, insurance on each side, notice before the buyer enters, the move-out standard and a daily charge if the seller stays late, while making clear it is a short permission to stay and not a lasting tenancy.

Tips before you send it
- Tell your lender about the rent-back early; many limit how long a seller can stay on an owner-occupied loan.
- Make the holdback big enough to matter, often well above the total fee.
- Ask your insurer whether your new policy needs a note that the seller is still living there.
- Save the signed agreement in your FileIt vault with the move-out date as its expiry date, so a reminder arrives before the walk-through.

Seller rent-back agreement: frequently asked questions
Does this make the seller my tenant?
The agreement says it is a short, temporary permission to stay, not an ongoing tenancy. Some places still apply tenant protections to any paid occupancy, and where they do, those minimum protections apply.
What if the seller doesn't leave on time?
They pay the daily late charge, which can come out of the holdback. That charge doesn't give them permission to stay, and the buyer can still use lawful process to recover the home and claim further loss.
Who pays for a broken furnace during the stay?
The buyer, as owner, for normal wear or system failures the seller didn't cause. The seller pays for damage they, their household or guests cause.
Can we sign it electronically before closing?
Yes, in most places. FileIt sends it to each signer and returns a signed PDF with an audit trail you can share with the closing agent.
