What is a booking agent agreement?
A good booking agent can turn a band, DJ or speaker from a few local dates into a full calendar. The relationship runs on trust, but it also involves real money: deposits from promoters, commission on every show, and offers accepted in the artist's name. When it goes wrong, it is usually because nobody wrote down whether the agent was exclusive, what commission was calculated on, whether the agent could accept an offer on its own, or who was holding the deposit.
This template appoints the agent for listed engagement types in a territory, exclusive or not, with any engagements the artist keeps for itself. You set the commission and what it is calculated on, choose whether the agent may accept only approved offers or offers above a minimum fee, and decide whether deposits go straight to the artist or are held by the agent in a separate account and paid on within a set time. It covers commission on cancellations and a six-month tail for introduced promoters, record keeping, conflicts when an agent also acts for a promoter, and the fact that some places license agents or cap commissions.

Tips before you send it
- Some places require talent or booking agents to hold a licence, limit commission or require approved contracts. Check the rules where the agent works and where the artist performs.
- Having deposits paid straight to the artist is simplest. If the agent holds money, insist on a separate account and quick payment.
- Agree in writing which existing contacts and residencies stay outside the agent's commission before you sign.
- Keep your availability calendar shared and current, especially if the agent can accept offers without asking you.

Booking agent agreement: frequently asked questions
What commission do booking agents charge?
It varies by market and type of artist, and some places cap it by law. The template lets you set any percentage and choose whether it is calculated on the gross fee, the fee excluding tax and travel costs, or the net fee.
Can the agent accept a gig without asking me?
Only if you choose that option, and only for available dates in the territory that meet your minimum fee and use your standard contract and rider. Otherwise every offer needs your written approval.
Does the agent get paid after the agreement ends?
Yes, on engagements already agreed, and on bookings with promoters the agent introduced that are agreed within six months after the end, unless the agreement was ended because of the agent's serious breach or dishonesty.
Is a booking agent the same as a manager?
No. A booking agent secures engagements. A manager guides the artist's whole career. The template says the agent does not manage the artist.
