What is Form I-865?

Form I-865 is the U.S. Citizenship and Immigration Services notice a sponsor files after moving. Anyone who signed Form I-864, I-864EZ or, as a household member, Form I-864A promised to report every change of address while the obligation to support the immigrant continues. The notice is due within 30 days of the move.

The obligation usually lasts until the sponsored immigrant becomes a U.S. citizen, can be credited with 40 quarters of work, leaves the United States permanently, or dies, so a sponsor may file this form several times over the years. The law sets civil fines for not reporting: $250 to $2,000, or $2,000 to $5,000 if the sponsor knew the immigrant had received means-tested public benefits. There is no filing fee.

FileIt walks you through the five-page notice: your new physical and mailing addresses with their effective dates, the people you sponsored and their A-Numbers, and your contact details, then prints everything on the official USCIS PDF. You print it and sign it by hand. FileIt keeps a copy in your vault but never files anything: you mail the notice to USCIS yourself.

How to fill out Form I-865, step by step

1 Part 1. Information about you

Your name, date of birth, your new physical address and the date it took effect. Item 5 asks whether that is also your mailing address; if not, give the new mailing address and its effective date in items 6 and 7.

2 Part 2. The sponsored immigrants

The name and A-Number of each person you sponsored. Four fit on the form; list others in Part 6.

3 Part 3. Statement and contact details

Say whether you read the notice yourself or an interpreter read it to you, and whether someone prepared it for you. Add your phone numbers and email, then sign by hand and date it.

4 Parts 4 and 5. Interpreter and preparer

Only if someone helped. Each gives their name, address and contact details and signs their certification.

5 Part 6. Additional information

Extra space for more sponsored immigrants or any answer that didn't fit. Your name prints at the top for you.

Common mistakes to avoid

  • Waiting more than 30 days after the move.
  • Thinking a divorce or the immigrant's move ends the duty to report: the obligation continues until one of the ending events happens.
  • Giving only the mailing address when your physical address changed too.
  • Leaving out a sponsored immigrant's A-Number when you have it.
  • Typing a name instead of signing by hand.

After you fill it out

Print the notice, check each page, sign Part 3 by hand and mail it to the address on the USCIS Form I-865 page.

Keep a copy with your Affidavit of Support records. FileIt keeps the filled PDF in your vault.

If the sponsored immigrant has an application pending, they should update their own address separately (Form AR-11 or online).
