What is N211 Part 20 claim form?

Part 20 of the Civil Procedure Rules lets a party already in a court case in England and Wales make an 'additional claim': for example a defendant who says someone else is really responsible, and wants a contribution or an indemnity from them, or a counterclaim against a person who isn't the claimant. Form N211 is the claim form for it.

It repeats the court and claim number of the main claim, names the claimant and defendant there, and then the Part 20 claimant and Part 20 defendant. It has room for brief details of the claim, its value, the Part 20 defendant's address for service, the amounts and fee, the particulars of claim on page 2, a statement of truth and your address for documents.

FileIt asks for each part in plain English, totals the amounts, splits a Help with Fees reference into its boxes and fills HMCTS's own N211 PDF (12.20 edition). You sign it and take or send it to the court. FileIt never files anything for you.

How to fill out N211 Part 20 claim form, step by step

1 The main claim

Copy the court and claim number from the main claim, then the claimant(s) and defendant(s) as they are named there.

2 The Part 20 parties

Put yourself as the Part 20 claimant and the person you're claiming against as the Part 20 defendant, with their address for service in the box at the bottom of page 1.

3 Brief details and value

A concise statement of the nature of the claim and the remedy you seek, and its value. FileIt totals the amount claimed, court fee and legal representative's costs.

4 Particulars, statement of truth, address

Write the particulars of claim on page 2 or attach them, sign the statement of truth, and give your address for documents.

Common mistakes to avoid

  • Issuing it after your defence without the court's permission.
  • Naming the Part 20 defendant wrongly: use a company's full registered name and the right address for service.
  • Not serving copies on the Part 20 defendant and the other parties to the main claim, as N211A explains.
  • Ticking 'I believe...' when a legal representative signs: they use the second statement.

After you fill it out

Download the filled PDF and check it against the main claim's papers.

Sign the statement of truth, by hand or with FileIt's eSignature.

Make copies for yourself, the court, the Part 20 defendant and each other party, and take or send them to the court with the fee. FileIt doesn't file anything.

Keep the claim papers together in your FileIt vault.

Do I need the court's permission?

The N211A notes say that unless you issue the Part 20 claim before or at the same time as filing your defence to the main claim, you first need the court's permission.

What goes in the Value box?

In the County Court a fixed sum goes in 'Amount claimed'. Otherwise you state what you expect to recover, using the value statements in the current rules and notes. FileIt leaves the wording to you.
