What is INSS undertaking by an attorney or legal representative?
Someone who receives or manages an INSS benefit for another person — under a power of attorney, as a parent of a minor, as a court-appointed guardian or curator, as the holder of a custody order or as a provisional administrator — signs this Termo de Responsabilidade, Anexo XXVII of IN PRES/INSS 128 of 2022.
In it you undertake to tell the INSS within 30 days of any event that could end your representation: the death of the benefit holder or dependant, or the end of the legal representation. You also acknowledge that if you don't, you must return any amounts received unduly and are subject to the penalties of articles 171 and 299 of the Penal Code. You list up to four beneficiaries and tick the kind of representation.
FileIt checks every CPF, prints the names correctly even with non-Portuguese letters, and keeps the signed undertaking in your vault. FileIt never sends anything to the INSS.
