What is a drug and alcohol test consent?

A drug and alcohol policy says when testing can happen. This form is for the individual test: the moment an applicant reaches the pre-employment screen, or a manager asks an employee to test after an accident. Getting written consent on the day, with the reason and the result-sharing rules spelled out, protects the person tested and the employer.

The form names the employer and the person tested, whether they're an employee or an applicant, and the role. It records the reason (pre-employment, random, reasonable suspicion, post-accident, return to duty or follow-up) with optional details, what is tested and the sample, the substances screened, the collection site and laboratory, and who reviews positive results. It covers private collection and chain of custody, the chance to explain medicines, who receives results and how they're kept apart from the personnel file, asking for a copy or a retest, and what happens on refusal.

Using the drug and alcohol test consent, step by step

1 Who and why

Your company fills in from your account. Add the person's name, whether they're an employee or applicant, the role, and the reason. For suspicion or an accident, note the facts briefly.

2 The test

Choose drug, alcohol or both, describe the sample, and list the panel if you want it on record. Add the collection site, the lab and any medical review officer.

3 Results and refusal

Say who receives results, name your policy, and spell out the consequence of a refusal or confirmed positive.

4 Sign before collection

Send it to the person's phone to sign before they go to the collection site. You countersign, and the form is kept with your confidential HR records in FileIt.

Tips before you send it

  • Testing law differs widely: some places limit random testing, cannabis testing or pre-offer tests. Check before you rely on this form.
  • Keep test results separate from the general personnel file, with access limited to those who need them.
  • Pair it with your drug and alcohol policy acknowledgement so the rules were agreed in advance.
  • Give the person a real chance to explain a positive result before acting on it.

Drug and alcohol test consent: frequently asked questions

Does this replace a drug and alcohol policy?

No. The policy sets the rules for everyone; this form records consent to one particular test. Use it with the drug and alcohol policy acknowledgement.

Can the person refuse?

Yes, and the form says so. It also records the consequence you've set, such as a conditional offer being withdrawn or your disciplinary procedure applying.

Does the employer learn what medicines the person takes?

Not necessarily. The person can tell the collector or reviewer, doesn't have to tell the employer what a medicine is for, and gets to explain a positive result first.

Is drug testing legal where I am?

It depends on the place, the industry and the reason. The form says the employer is responsible for checking the test is lawful; it isn't legal advice.

Can the person sign on a phone at the collection site?

Yes. They need no FileIt account, and the signed PDF carries an audit trail and Certificate of Completion.
