What is a co-signer agreement?

When you co-sign a car loan, student loan or lease for a son, daughter, partner or friend, the lender can come to you for the full amount if they don't pay. The loan contract protects the lender, not you. A co-signer agreement is a separate, private agreement between the two of you that sets out what the borrower owes you in return.

This template records the loan, the lender, the amount and the regular payment, and anything bought with it. The borrower promises to make every payment, to give you proof each month, and not to increase or refinance the loan in a way that keeps you liable without your consent. They must warn you early if a payment is at risk and pass on any letter from the lender. If you do pay, they repay you within an agreed time, plus any fees, and you can ask them to co-operate in selling the car or other asset. It ends with a commitment to apply for a co-signer release or refinance alone. It says clearly that it doesn't change the lender's rights. Both of you initial every page.

Tips before you send it

  • Ask the lender whether you can have online access or duplicate statements. Hearing about a missed payment early protects your credit.
  • Check whether the lender offers a co-signer release after a run of on-time payments, and put that date in the agreement.
  • If a car is involved, make sure it's insured and that you know who holds the title.
  • Only co-sign an amount you could pay yourself if you had to.
  • Each of you can take independent legal advice before signing, especially for a large loan.

Co-signer agreement: frequently asked questions

Does this agreement protect me from the lender?

No. The lender can still ask the co-signer to pay. What this agreement gives you is a written promise from the borrower to pay, to warn you early and to repay you, which you can rely on if you have to step in.

What if I end up paying the loan?

Anything you pay becomes a debt the borrower owes you. They repay it within the days you set, or under a written repayment plan you agree to, plus any late fees or costs you had to cover.

How do I get off the loan?

The borrower commits to apply for a co-signer release or to refinance in their own name as soon as the lender's rules and their credit allow. The agreement ends once you're released and repaid.

Is an electronically signed co-signer agreement valid?

Electronic signatures are generally valid for private agreements like this in the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada. FileIt keeps an audit trail and a Certificate of Completion with the signed PDF.
