What is ZUS ZAM maternity allowance claim?

ZAM (Wniosek o zasiłek macierzyński) is the Polish Social Insurance Institution's application for maternity allowance. It covers maternity leave after a birth, leave on maternity-leave terms after taking a child in for adoption or foster care, and the newer supplementary maternity leave (uzupełniający urlop macierzyński) for babies born prematurely or kept in hospital. You can claim parental leave on the same application.

The form also handles the less common cases: starting leave before the birth, a child born after your job ended because the employer went bankrupt, was liquidated, ended your contract unlawfully or died, a father or other family member taking over from the mother, and leave after a discharge from hospital. A statement on page 4 says whether the child's other parent will also use the allowance.

Who needs to fill out ZUS ZAM maternity allowance claim?

Insured mothers claiming maternity allowance for maternity leave after giving birth.
Parents who have taken a child in for adoption, or as a non-professional foster family, and claim leave on maternity-leave terms.
Parents of a premature baby, or a baby kept in hospital after birth, claiming supplementary maternity leave.
Fathers or other insured family members who take over the allowance because the mother is in hospital, has a disability certificate, returns to work, has abandoned the child or has died.
Women whose child was born after their employment ended because the employer went bankrupt or into liquidation, ended the contract unlawfully, or died.

When to use ZUS ZAM maternity allowance claim

When your maternity leave starts, before or after the birth.
When you want to claim maternity leave and parental leave together in one application.
When your baby qualifies for supplementary maternity leave because of an early birth, low birth weight or a hospital stay.
When you take over maternity leave from the child's mother. If you are only asking for parental leave allowance during or after a break, use ZUS form ZUR instead.

What you need before you start

Your PESEL, or an identity document and date of birth if you have no PESEL.
Your address and, if you like, a phone number.
Your employer's NIP (or REGON) and name.
A Polish bank account number, if you want the allowance paid into an account.
The dates of each leave period you are claiming.
The child's name, date and place of birth, and for supplementary leave the dates of the hospital stay.
Details of the child's other parent, if they will also use the allowance.

How to fill out ZUS ZAM maternity allowance claim, step by step

1 Your details and your payer

Your PESEL, name and address, then the details of the payer of contributions: usually your employer's NIP and name. Give a REGON, PESEL or identity document only if the payer has no NIP.

2 Bank account

Optional. Without an account number, the allowance is sent by postal order to your address. FileIt checks the 26-digit number's control digits.

3 What you are claiming (Zakres wniosku)

Tick maternity leave (or leave on its terms), parental leave and supplementary maternity leave as they apply, and give each period's start and end. 4 Reasons 1 and 2

Reason 1 is the birth, or taking a child in for adoption or foster care (with the date you took the child in). Give each child's name, date and place of birth, and say if a child has the 'Za życiem' certificate. Reason 2 is for starting leave before the birth, with the expected date of birth.

5 Reasons 3 and 4

Reason 3 is a birth after your employment ended for one of the four listed reasons. Reason 4 is supplementary maternity leave: tick the situation that applies to your baby, such as birth before the 28th week or a birth weight of no more than 1000 g, and give the hospital stay.

6 Reasons 5 and 6

Reason 5 is for a father or family member taking over because of the mother's situation, with the date and the mother's details. Reason 6 covers leave after you or the child left hospital.

7 The other parent

If you claim parental or supplementary leave, say whether the child's other parent will also use maternity allowance for that leave and for which period, and give their details on page 5.

8 Date and signature

Date the form on page 5 and sign it by hand after printing.

Common mistakes to avoid

Using ZAM when you only want parental leave allowance after maternity leave has started; that is form ZUR.
Ticking supplementary maternity leave without filling in reason 4 and the hospital stay.
Giving periods that overlap or end before they start.
Leaving out the statement about the other parent when you also claim parental leave.
Forgetting to sign the printed form.

What is the difference between ZAM and ZUR?

ZAM is the main maternity allowance application: maternity leave, leave on its terms, supplementary maternity leave, and optionally parental leave in the same claim. ZUR is for claiming parental leave allowance on its own, while you are receiving maternity allowance or after a break in it.

Who do I give ZAM to?

To whoever pays your sickness and maternity benefits: usually your employer, or ZUS directly if ZUS pays you (for example if you are self-employed or your employer has 20 or fewer insured people).

Can a father use ZAM?

Yes. Reason 5 is for a father or another insured family member who takes over the allowance because of the mother's situation, and reason 1 also covers taking a child in for adoption or foster care.

What is supplementary maternity leave?

Extra maternity leave for a baby born prematurely, with a very low birth weight, or kept in hospital after birth. You claim it in reason 4 of ZAM with the dates of the hospital stay.

Can I fill in ZAM online with FileIt?
