What is Verf 16 — tax registration questionnaire (partnerships)?

Verf 16 is the Austrian tax office's registration questionnaire for partnerships and communities: joint ventures (ARGE), atypical silent partnerships, civil-law partnerships (GesbR), GmbH & Co KG, limited partnerships (KG), general partnerships (OG) and letting co-ownerships such as a Hausgemeinschaft. It is published by the Federal Ministry of Finance (Bundesministerium für Finanzen, BMF). The edition covered here is Verf 16-PDF, Version vom 15.11.2023.

The questionnaire asks for the partnership's name, place of management, start date and phone, its legal form and kinds of income, an exact description of the activity, its companies register entry and balance sheet date, the expected turnover and profit for the opening year and the following year, whether it opts into normal VAT, other levies, each partner's tax number and share with the representative under § 81 BAO, and any power of attorney or address for service.

FileIt explains each question in English, with the German terms alongside, and prints your answers into the official BMF PDF, with dates, amounts and shares in Austrian format. The finished PDF is saved in your FileIt vault. FileIt doesn't send anything: you sign the questionnaire and send it to the tax office yourself.

How to fill out Verf 16 — tax registration questionnaire (partnerships), step by step

1 Page 1: the cover sheet

Page 1 is normally the tax office's covering letter. If you send the questionnaire on your own, fill in the office's address and the partnership's name and address, tick what it concerns (farming or forestry, self-employed activity, trade business, letting) and the documents you enclose. FileIt leaves the office's own boxes empty.

2 The partnership

The name, address with postcode and town, start date, phone, legal form, kinds of income and an exact description of the activity. Then the companies register entry, the balance sheet date, whether a closing date other than 31 December also applies to VAT (§ 20 (1) UStG 1994), and the expected number of employees.

3 Turnover and profit

The expected annual turnover and profit for the opening year and the following year, in euros. A loss is entered with a minus sign.

4 VAT and other levies

A small business that applies for normal VAT taxation under § 6 (3) UStG 1994 gives the year it applies from. Then tick NoVA, motor vehicle tax or advertising tax if they apply.

5 Partners

For each partner, their tax number and share in percent, and tick the partner who represents the partnership under § 81 BAO. The form has six rows; further partners go on form Verf 60.

6 Power of attorney, address and signature

Name any authorised person and tick whether a power of attorney for tax representation, an order to register the partnership or a power to receive all documents exists, with the address for service. Tick if you are the § 81 BAO representative and give that address for service. Print your name, date the form and sign. A professional representative confirms the signatories' identity and signs beside their own date.

Common mistakes to avoid

  • Using Verf 16 for a GmbH or AG. Companies use Verf 15.
  • Leaving out the fields marked with an asterisk, such as the legal form, the kinds of income or the turnover and profit.
  • Describing the activity too vaguely. The form's own example asks for 'Gemüsehandel' rather than 'trade in goods of all kinds'.
  • Not naming a § 81 BAO representative among the partners.
  • Shares that add up to more than 100 percent.

After you fill it out

Print the questionnaire from FileIt, sign it, and send it to the tax office with the documents asked for. The office's cover page asks for it back within one month.

The office registers the partnership and gives it a tax number. Keep the filled questionnaire in your FileIt vault with the partnership agreement.
