What is a affiliate marketing agreement?

An affiliate programme pays bloggers, reviewers, creators and niche websites a commission for the sales they send you. It only works if both sides agree how a sale is credited, when commission becomes final and how it's paid — and if you've ruled out the shortcuts that can damage your brand, such as bidding on your name in search ads or stuffing cookies.

This template admits one affiliate to your programme on a non-exclusive basis. It covers the products included and the channels they'll use, last-click attribution within a cookie window you set, which tracking records count, commission on every sale or on new customers only, a confirmation period that matches your returns window, a minimum payout with carry-forward, a list of banned promotion methods plus any you add, disclosure of the affiliate relationship, a limited licence to use your logos and banners, and notice to change terms or end the arrangement.

Using the affiliate marketing agreement, step by step

1 Describe the products and channels

List what the affiliate can promote and any exclusions such as gift cards. Name their websites, channels or newsletters so it's clear where your links will appear.

2 Set the commission rules

Enter the rate, choose every sale or first orders only, and set the cookie window and the number of days before a sale is confirmed — usually your returns window.

3 Agree payment

Pick a payout schedule, the minimum payout and the payment method. Amounts below the minimum roll forward to the next period.

4 Add any extra rules and send

Add rules specific to your programme, such as no coupon sites. Sign as the merchant and send the agreement to the affiliate — they don't need a FileIt account to sign.

Tips before you send it

  • Write down your brand bidding policy before you recruit: it's the most common source of affiliate disputes.
  • Match the confirmation period to your real returns and chargeback window so you're not paying commission on refunded orders.
  • Advertising regulators in many countries expect affiliates to disclose that they earn commission — check the rules where your affiliate publishes.
  • Send your logo pack and brand guidelines with the agreement, so the affiliate has approved material from day one.

Sign it online in minutes

  1. Fill in the blanks. Names, dates and amounts go straight into the agreement — the preview shows exactly where.
  2. Name who signs. Tick “This is me” for your own part. FileIt builds the PDF with every signature, date and initials box on the right line, and you can check or move anything before sending.
  3. Send it. Each signer gets a secure link and signs from any device — no account needed. The signed PDF, with an audit trail and a Certificate of Completion, is filed in your vault and emailed to everyone.

Affiliate marketing agreement: frequently asked questions

What is a cookie window?

It's the number of days after a customer clicks an affiliate's link during which a purchase still counts for that affiliate. This template credits the last affiliate link clicked within the window you choose.

Can I change the commission rate later?

Yes, for future sales, by giving the affiliate the notice period you set. Commission on sales already made is paid at the rate that applied when they were made.

How is this different from a referral agreement?

A referral agreement usually pays a finder's fee for introducing a specific client or deal. An affiliate agreement covers ongoing online promotion, tracked automatically through links. FileIt has templates for both.

Can it be signed electronically?

In most countries, including the US (ESIGN Act and UETA), the UK, the EU (eIDAS) and Canada, an electronic signature is generally valid for an ordinary commercial contract like this one. FileIt keeps an audit trail and a Certificate of Completion with the signed PDF as evidence of who signed and when.

Is this template free?

Yes. The template is free to use with the eSignature app in FileIt, and the people you send it to don't need a FileIt account to sign.
