What is Cerfa 11530 - family judge request (children)?

When parents separate, or when an existing arrangement no longer works, the family judge (juge aux affaires familiales, JAF) can decide how parental authority is exercised, where the children usually live, the other parent's contact and staying rights (droit de visite et d'hébergement), and child support (pension alimentaire). Cerfa 11530*11 is the request for that. One parent can file it, or both parents can sign it together as a joint request (requête conjointe). The form says it can't be used for a divorce or legal separation, or to end or change a compensatory payment (prestation compensatoire). Those need a lawyer, as do grandparents asking for contact rights.

The seven pages cover who you are (and the second parent for a joint request), the other party, up to three children with their addresses, the court decisions already made, and what you ask for under five headings: parental authority, residence, contact and staying rights, child support, and other requests. Then come your reasons, what you have done to reach an agreement, whether you agree to a decision without a hearing, and a signed declaration.

FileIt asks the questions in plain English and writes your answers on the form's own lines and boxes, including the dates, postcodes and phone numbers in their little cells. Long answers like your reasons are spread over the ruled lines, and FileIt tells you when a text won't fit. The filled PDF is saved in your vault. You sign it and file it with the court yourself. FileIt never submits anything, and the judge decides on every request.

How to fill out Cerfa 11530 - family judge request (children), step by step

1 Votre identité and the second applicant

Your identity, address, contact details and legal aid. For a joint request signed by both parents, the second parent's details follow on page 2. Otherwise skip that block.

2 L'autre partie

For a request by one parent, the other parent's identity and address. The court uses it to summon them.

3 Les enfants

Up to three children, with a second address if they live alternately with each parent. For more children, attach a page with the same details.

4 Votre situation

Whether you are divorced from the other parent (date and court), or the date you separated. Then whether a court has already ruled about the children, by the family judge, the children's judge or another court.

5 Votre demande

Tick the measures you ask for. Parental authority: joint, by one parent, or another request. Residence: with one parent, or alternating. Contact and staying rights: set up, change or end them, and how they would work. Child support: set, end, suspend or change it, or have it paid through the CAF or MSA. And any other request.

6 Motifs and amicable settlement

Explain your reasons on the 13 lines. Then say whether you tried to settle the matter amicably (a letter to the other parent, a family mediator, or something else), or why you didn't. The form says the judge may then propose mediation.

7 Consent and declaration

Say whether you agree to the case being decided without a hearing. All parties must agree, and the court can still hold one. Then the declaration on your honour, place, date and signature, and the second parent's for a joint request.

Common mistakes to avoid

  • Using this form for a divorce or a compensatory payment. Those need a lawyer.
  • Leaving out the other parent's address. The court needs it to summon them.
  • Asking for a measure without explaining why. The reasons section must always be filled in.
  • Forgetting the second parent's signature on a joint request.
  • Not mentioning an earlier judgment about the children, or its date and court.
  • Writing more than the lines hold instead of attaching a separate sheet.
  • Forgetting the supporting documents listed in notice 50720.

After you fill it out

Sign page 7 (both parents for a joint request) and gather the supporting documents listed in notice 50720.

File the request with the family judge of the tribunal judiciaire, by post or at the court registry, as the notice explains. FileIt does not send it for you. To get the court's notices by e-mail, also fill in cerfa 15414.

Keep the filled PDF in your FileIt vault with the children's documents, so you can find it when the hearing date or the decision arrives.
