What is V0027 — Statusfeststellung (Erwerbsstatus)?

Whether a contract is employment or self-employment decides who pays social insurance. The status determination procedure (Statusfeststellungsverfahren, § 7a SGB IV) gives contractor and client legal certainty: the Clearingstelle of the Deutsche Rentenversicherung Bund decides whether the contractor is employed or self-employed, and who the employer is. Its explanatory notes (V0028) say the decision binds the other social insurance bodies and the employment agency.

Form V0027 is the application. The contractor, the client or both together can apply, either for a running engagement or, with a written contract, before the work starts. It asks about both parties, the work and its dates, framework contracts, family ties, GmbH or KG roles, third parties such as an end customer, earlier procedures and group determinations, the contractor's health insurance and company shares, the client's social insurance audits and agency-work licence, and the result each party asks for. The description of the engagement goes on annex C0031 (C0032 for GmbH/KG roles, C0033 for family members).

Who needs to fill out V0027 — Statusfeststellung (Erwerbsstatus)?

  • Freelancers and their clients who are unsure whether the engagement is employment or self-employment.
  • Interim managers, IT consultants and specialists placed with an end customer through an agency (a three-party arrangement).
  • Shareholder-managing directors and working shareholders of a GmbH, and limited partners of a KG (with annex C0032).
  • Family members working in a relative's business (with annex C0033).

When to use V0027 — Statusfeststellung (Erwerbsstatus)

  • Before the work starts, if a written contract exists — V0028 says both decisions are equally final.
  • After the work has started. V0028 says that if employment is found and the application was made within a month of starting, insurance can start only when the decision is announced, if the employee agrees and had their own cover for illness and old age.
  • Not when a health insurance fund or a pension insurance audit has already decided or started a procedure on the same work — V0028 says the Clearingstelle then has to reject the application.

  • Both parties' details: the contractor's pension insurance number, the client's company name and Betriebsnummer.
  • The exact name of the work, its start and (if ended) end date, and any framework-contract periods.
  • All individual contracts, project and task descriptions, the terms and conditions (AGB) if part of them, and invoices.
  • The annex C0031 (or C0032 / C0033) describing how the work is actually done.
  • For three-party arrangements: the third party's name and address, and if possible the contract between the client and its customer.

Status determination under § 7a Abs. 1 SGB IV, or before the work starts under § 7a Abs. 4a.

The contractor's personal details and the client's company details.

3 3 to 6

The work, its dates and earnings, framework contracts, written agreements, family ties, GmbH or KG roles, and any third party.

4 7 and 8

Earlier status procedures and decisions, and any expert opinion (group determination) for the same kind of work.

Who applies: the contractor (then parts 10, 11 and 14), the client (parts 12 and 15) or both together.

The contractor's health insurance, the client's confirmation of the answers (10.2), company shares, and board membership of an AG.

From the client: social insurance audits (Betriebsprüfung) and a temporary-agency-work licence.

Common mistakes to avoid

  • Sending the form without annex C0031 and the contracts — the form says the status can't be decided without them.
  • Applying although a health insurance fund or a Betriebsprüfung already covers the same work.
  • Forgetting that each client relationship is assessed separately — one application per client, V0028 says.
  • Leaving out the end customer in a three-party arrangement.
  • Answering part 12 as the contractor alone — it is the client's.

After you fill it out

Print the form; the contractor signs on page 6, the client in 10.2 on page 5 and on page 7, with the company stamp.

Post it with the annex and copies of the contracts to Deutsche Rentenversicherung Bund, Clearingstelle, 10704 Berlin. FileIt doesn't send it.

Who decides, and is the decision binding?

The Clearingstelle of the Deutsche Rentenversicherung Bund. V0028 says the other insurance carriers and, since 2005, the employment agency are bound by its decision.

Do both parties have to sign?

V0028 recommends that contractor and client fill in and sign it together, and says at least one contracting party must sign. If only one applies, the Clearingstelle involves the other.

Can I apply before the work starts?

Yes, if a written contract exists. If a decision before the start is no longer possible in time, the form says the application is treated as one for the running engagement.

What if employment is found?

V0028 says the employer must register the employee with the health insurance fund and pay the contributions, which become due when the decision can no longer be appealed.

Is this the same as V0050?

No. V0027 decides employment or self-employment. V0050 is the application to be exempted from compulsory pension insurance as a self-employed person with one client.
